    Really interesting stuff and it shows how often these rulings are sort of "dumbed down" by the media. this seems to me like it was more of a procedural issue. they werent saying that the test wasnt biased but they were saying that they didnt violate the spirit of the "disparate effect" clause of Title VII. It seems that had the city done a little more homework they either wouldnt have brought the case at all or they could have gotten the test results thrown out.

    it was very interesting and, in my mind, probably the right ruling. I believe the Civil Rights Act is necessary but like separation of church and state and affirmative action and things of that sort the spirit of the law is really what needs to be observed closely otherwise we end up with silly results that are unfair to everyone.
